1.1 Personal Information: For Teachers: When you create an account, we may collect personal information such as your name, email address, school affiliation, and other relevant contact information. For Students: We do not directly collect personal information from students. We rely on the information provided by teachers, which may include student names or identification codes for grading purposes. Because we do not collect personal information, so this policy is compliant with the Children's Online Privacy Protection Act (COPPA), the Family Educational Rights and Privacy Act (FERPA), and other relevant U.S. regulations to ensure the privacy and security of student data.

1.2 Grading Data: Teachers provide assignment questions, rubrics, and student answers to Cograder for grading purposes. This data may include text, images, or other media elements. We consider this data as educational records and treat it in accordance with FERPA regulations.

1.3 Usage Information: We collect non-personal information about your interactions with Cograder, such as your IP address, device information, browser type, and usage patterns. This information is used to improve our services, enhance user experience, and ensure system integrity and security.

2. Use of Collected Information

2.1 Providing and Improving Services: We use the personal and grading data to provide you with the requested grading services, generate graded assessments, and provide feedback. We may use aggregated and anonymized data for research and development purposes to improve the feedback quality, features, and overall user experience.

Restrictions on Data Use: CoGrader does not use students' data to train AI models. Additionally, we do not permit our third-party AI providers to use this data for their model training.

2.2 Communications: We may use your email address to send important notifications, updates, and other relevant information about our services.

2.3 Compliance with Laws: We may disclose personal information if required by law, legal process, or to protect the rights, property, or safety of Cograder, our users, or others.

3. Data Security and Retention

3.1 Data Security: We implement reasonable security measures to protect personal information from unauthorized access, disclosure, alteration, or destruction. We use encryption technologies, secure storage, access controls, and regularly update our security practices to safeguard your information.

3.2 Data Retention: We retain personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. We retain educational records in accordance with FERPA regulations and maintain the integrity and security of the educational system.

4. Sharing of Information

4.1 Service Providers: We may engage trusted third-party service providers to perform functions on our behalf, such as hosting, data analysis, and customer support. These providers will only have access to the information necessary to perform their functions and are obligated to maintain its confidentiality.

4.2 Aggregate Data: We may share aggregated and anonymized data for research, statistical analysis, or other purposes. This data does not identify individuals.

4.3 Third-Party AI Platform:  To provide our grading services, we share anonymized information, such as assignment questions, rubrics, and answers, with OpenAI OpCo, LLC. This is currently the only third-party AI platform we use. Please note that OpenAI OpCo, LLC has its own privacy policy governing their use and protection of data, which is fully accessible here. We take steps to ensure that   the data we share with them does not identify individuals and is used  solely for the purpose of providing our services.

5. Your Rights and Choices

5.1 Access and Update: Teachers can access and update their personal information by logging into their Cograder account.

5.2 Opt-Out: You may opt-out of receiving non-essential communications from us by following the instructions provided in those communications.

5.3 Deletion: If you would like us to delete your personal information, please contact us using the information provided at the end of this Privacy Policy. However, please note that we may be required to retain certain information for legal or legitimate business purposes.
